1. Who we are
This website and the Soku brand are operated by OOMPH Productions B.V. ("OOMPH", "Soku", "we", "us"), Delfgauw, The Netherlands, registered with the Dutch Chamber of Commerce (KvK) under number 86129767.
We are the controller for the personal data described in this policy. Privacy contact: info@soku.global. This policy supplements our General Terms & Conditions.
2. What data we collect
We collect data directly from you:
- Identity & contact — name, email, phone, company, address.
- Order & transaction — products, order history, delivery address, payment status (card data is handled by our payment provider; we do not store full card numbers).
- Lead / enquiry — your message, interest, role, organisation and location.
- Website usage — IP, device/browser, pages viewed and referrer, via cookies.
- Communications — emails and messages you send us.
3. Why we use your data, and our legal basis
- Process and deliver your order and provide rental/warranty services — performance of a contract.
- Respond to your enquiry or quote request — contract / pre-contract steps.
- Handle your enquiry ourselves and/or forward it to the local sales partner for your region so you are served — our legitimate interests, and, where it leads to a sale, pre-contract steps.
- Invoicing, accounting, tax and legal obligations — legal obligation.
- Secure, maintain and improve our website and prevent fraud — our legitimate interests.
- Service messages about products you have bought — our legitimate interests, with opt-out.
- Optional marketing emails and newsletters from Soku — your consent.
We will not use your data for new, incompatible purposes without informing you and, where required, obtaining your consent.
4. How we handle your enquiry
We sell and service Soku products both directly and through a network of local sales partners. When you send us a business enquiry, we may handle it ourselves and/or forward it, together with your contact details, to the local sales partner for your region so you are served as effectively as possible. We do this on the basis of our legitimate interest in handling your enquiry through the party best placed to help you — something you can reasonably expect when contacting a manufacturer that sells both directly and through sales partners.
You can object to your enquiry being forwarded at any time, before or after, by contacting info@soku.global; if you object before we have acted, we will handle your enquiry directly instead where possible.
Separately, you may opt in to marketing emails and newsletters directly from Soku. That is optional, not required to receive a reply, and you can withdraw it at any time via the unsubscribe link in any message.
5. Sharing your data
We share personal data only with:
- Local sales partners — independent businesses (such as resellers, dealers and distributors) that sell and service Soku products in your region. Where we do not handle your enquiry ourselves, we forward your enquiry and contact details to the sales partner for your area so they can respond to and serve you. A current overview of our sales partners is available on request.
- Service providers acting on our behalf — in categories such as our webshop and hosting platform, payment, shipping and logistics, and email and customer-management tools. They act under a data processing agreement and may only use the data to provide their service to us.
- Authorities or professional advisors where required by law, or to establish, exercise or defend legal claims.
- A buyer in the event of a merger, acquisition or reorganisation, subject to this policy.
We do not sell your personal data.
6. International transfers
Some of our service providers may process data outside the European Economic Area, including in the United States. Where that happens, the transfer is protected by an appropriate safeguard recognised under the GDPR — an EU adequacy decision or the European Commission's Standard Contractual Clauses.
7. Your rights
Under the GDPR you have the right to access your data; rectify inaccuracies; request erasure; restrict or object to processing (including objecting to direct marketing at any time); data portability; and to withdraw consent at any time (without affecting prior lawful use).
To exercise any right, email info@soku.global. We respond within one month. You may also lodge a complaint with the Dutch supervisory authority, the Autoriteit Persoonsgegevens (autoriteitpersoonsgegevens.nl).
8. Cookies
Our webshop platform manages our cookie banner and consent. Strictly necessary cookies keep the site working; analytics and marketing cookies are only placed with your consent. You can review and change your choices at any time through the cookie-preferences link in the website footer.
9. How long we keep data
We sell on a business-to-business basis and keep personal data (which for our B2B customers is mainly the contact details of people at those businesses) only as long as necessary:
- Order & invoice records: 7 years (Dutch tax-law retention obligation).
- Lead / enquiry & business-relationship data: for the duration of our business relationship and up to 24 months after our last contact, then deleted.
- Marketing-consent data: until you withdraw consent, then suppressed or deleted.
- Website analytics: no longer than 24 months.
10. Security
We take appropriate technical and organisational measures to protect personal data against loss and unauthorised access. If a data breach affects your rights, we will notify the Autoriteit Persoonsgegevens and, where required, you.
11. Children
Our products and site are aimed at adults and organisations. We do not knowingly collect data from children under 16 without parental consent.
12. Changes to this policy
We may update this policy. The current version is always on our website with its "last updated" date. Material changes affecting consent will be communicated to you.
